Welcome to Pasture Pool. These Terms & Conditions govern your access to and use of our website, online store, and related services. By accessing or using the Services, creating an account, or making a purchase, you agree to these Terms and our Privacy Policy and Shipping Policy.

 

If you do not agree, do not use the Services.

2) Eligibility & accounts

• Age. You must be at least 18 to make a purchase. Users 13–17 may browse the site only with the involvement of a parent/guardian.

• Account security. You’re responsible for maintaining the confidentiality of your login and for all activity under your account. Notify us immediately of unauthorized use.

• Accuracy. Provide accurate, current information and keep it updated.

 

3) U.S. only sales and shipping

We currently sell and ship only within the United States. See our Shipping Policy for details. Risk of loss and title pass to you upon our delivery of goods to the carrier, except as otherwise required by law.

 

4) Orders, availability, and acceptance

• Offer & acceptance. Your order is an offer to buy. We may accept by shipping the product(s) or by otherwise confirming acceptance. We may decline or cancel any order (and refund you) for reasons including: product unavailability, pricing/description errors, suspected fraud or abuse, violation of these Terms, or shipping restrictions.

• Quantity limits & resale. We may limit quantities per person, per household, or per order. Purchases for resale are not permitted without our prior written consent.

• Pre‑orders/backorders. Estimated dates are not guaranteed and may change. You may cancel before shipment for a full refund if you no longer wish to wait.

• Substitutions. We generally do not substitute items without your consent, except where required to correct an error or fulfill a warranty/return.

 

5) Pricing, taxes, and payment

• Prices. All prices are shown in U.S. dollars and exclude applicable taxes and shipping unless stated. We may change prices at any time before order acceptance.

• Errors. We make reasonable efforts to ensure accuracy, but errors may occur. If we discover an error after you place an order, we may cancel and issue a refund or contact you for instructions.

• Taxes. We collect sales/use taxes as required by law based on the delivery address.

• Payment methods. We accept [list: Visa, MasterCard, Amex, Discover, PayPal, Shop Pay, etc.]. By submitting a payment method, you represent that you are authorized to use it and authorize us (and our payment processors) to charge the order total, including shipping and taxes. We do not store full card numbers.

• Promotions & coupons. Unless stated otherwise, promotions cannot be combined, have no cash value, and are subject to additional terms. We may modify or end any promotion at any time.

 

6) Delivery, risk of loss, and inspection

• Delivery. Transit times are estimates provided by carriers and are not guaranteed.

• Risk of loss. Risk of loss passes to you when the carrier takes possession. Consider shipping to a secure location or selecting signature‑required delivery for high‑value items.

• Inspection. Please inspect your order upon receipt and contact us within 7 days of delivery regarding missing, incorrect, or damaged items.

 

7) Returns, exchanges, and refunds

Your purchase is subject to our Returns & Exchanges Policy. Unless required by law or stated otherwise in that policy, original shipping charges are non‑refundable, and you are responsible for return shipping. Items must be returned in their original condition with all packaging and accessories.

 

8) Product information

• Descriptions & colors. We try to be accurate, but we do not warrant that product descriptions, images, or specifications are complete, current, or error‑free. Screen displays and lighting can affect color appearance.

• Safety & proper use. Golf equipment and accessories should be used only as intended and in accordance with manufacturer instructions and applicable safety guidelines. You are responsible for determining that products are appropriate for your skill level and conditions of use.

• Third‑party products. Manufacturer warranties (if any) may apply. We are not the manufacturer and do not make independent warranties beyond those required by law.

 

9) Prohibited conduct

You agree not to, and not to allow others to:

• Use the Services for unlawful purposes, to violate any applicable law or regulation, or to infringe others’ rights;

• Interfere with or disrupt the Services, bypass or breach security, or probe, scan, or test vulnerabilities;

• Use bots, scrapers, or similar tools without our express written permission;

• Misrepresent your identity, attempt to gain unauthorized access to accounts, or engage in fraud or resale without authorization;

• Post or transmit content that is illegal, harmful, defamatory, obscene, harassing, or infringing.

We may suspend or terminate access for violations.

 

10) User content

If you submit reviews, photos, questions, or other content, you grant Pasture Pool a non‑exclusive, worldwide, royalty‑free, transferable, sublicensable, perpetual and irrevocable license to use, host, store, reproduce, modify, translate, create derivative works, publish, publicly perform, display, and distribute such content in any media for any lawful purpose, including marketing and improving the Services. You represent that you own or control the rights to your User Content and that it is accurate and not misleading or infringing. We may remove or edit User Content at any time.

 

11) Intellectual property

The Services, including all content, text, graphics, logos, product names, product designs, photos, videos, and software, are owned by Pasture Pool or our licensors and are protected by U.S. and international laws.

 

12) DMCA/Copyright policy

We respect intellectual‑property rights. If you believe content on the Services infringes your copyright, send a notice that includes the information required by 17 U.S.C. §512(c)(3)

We may remove or disable access to alleged infringing material and may terminate repeat infringers’ accounts.

The Services may link to third‑party websites, apps, or services (including payment providers and social networks). We are not responsible for third‑party content, terms, or policies. Your use of third‑party services is at your own risk and subject to those third parties’ terms.

 

14) Mobile/SMS terms

By providing your mobile number and opting in, you consent to receive marketing and transactional texts from Pasture Pool. Message and data rates may apply. Message frequency varies. Reply STOP to cancel, HELP for help. Consent is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we process your data.

 

15) Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PASTURE POOL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT DEFECTS WILL BE CORRECTED.

 

Some states do not allow limitations on implied warranties, so some limitations may not apply to you.

 

16) Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PASTURE POOL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID TO PASTURE POOL FOR THE PRODUCT OR SERVICE AT ISSUE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

 

Nothing in these Terms limits liability for gross negligence, willful misconduct, or injury where such limitation is prohibited by law. Some states do not allow the exclusion or limitation of certain damages, so the above may not apply to you.

 

18) Indemnification

You agree to defend, indemnify, and hold harmless Pasture Pool and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the Services, or your infringement or violation of any rights of another.

 

19) Force majeure

We are not liable for any delay or failure to perform due to events beyond our reasonable control, including acts of God, labor disputes, supply shortages, war, terrorism, epidemics, governmental action, natural disasters, power or internet failures, or carrier delays.

 

20) Communications & electronic records

By using the Services, you consent to receiving communications from us electronically (e.g., email, site notices). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by law.

 

21) Changes to the Services and to these Terms

We may update the Services and these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms and updating the “Last updated” date above (and, if appropriate, by additional notice). Your continued use of the Services after the changes become effective constitutes your acceptance of the updated Terms.

 

22) Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, sale of assets, or by operation of law.

 

23) Severability; no waiver; entire agreement

If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver. These Terms, together with the policies incorporated by reference (Privacy Policy, Shipping Policy, Returns & Exchanges Policy, and any additional product‑ or promotion‑specific terms), constitute the entire agreement between you and Pasture Pool.

 

24) State‑specific notices

Where required by state law, certain additional rights may apply to you. Nothing in these Terms is intended to limit any non‑waivable consumer rights under applicable law.

• California Proposition 65. Some products may include chemicals known to the State of California to cause cancer or reproductive harm. Where applicable, we will provide Prop 65 warnings on product or checkout pages.

• New Jersey Notice. The sections titled Disclaimer of Warranties, Limitation of Liability, and Indemnification constitute important legal notices to New Jersey consumers.

• Colorado/Connecticut/Virginia/Other state privacy rights. See our Privacy Policy for your rights and how to exercise them.
