These Terms & Conditions ("Terms") govern your use of pasturepoolgolf.com and the online store, accounts, content, and related services offered by Pasture Pool Golf Brand ("Pasture Pool," "we," "us," or "our") (collectively, the "Services").
By using the Services or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refund Policy. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be at least 18 years old, or the age of legal majority where you live, to place an order. A parent or legal guardian may place an order for a minor.
If you create an account, you agree to provide accurate information, keep your credentials confidential, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account to the extent permitted by law. We may suspend or close an account used fraudulently, unlawfully, or in violation of these Terms.
2. Products and availability
We sell apparel, accessories, gift cards, and other golf-lifestyle products. Many physical products are made or printed after an order is placed.
We try to display product descriptions, colors, sizes, images, and availability accurately. Screen settings, photography, manufacturing variations, and the print-on-demand process may cause minor differences. Product measurements are approximate unless stated otherwise.
Products may be changed, discontinued, or limited in quantity without notice. Adding an item to a cart does not reserve it.
3. Orders and acceptance
Your order is an offer to purchase. We may accept an order by sending an acceptance or fulfillment confirmation or by shipping the product. An automated order confirmation only acknowledges that we received the order.
We may reject, limit, or cancel an order before shipment for reasons such as product or material unavailability, an incorrect price or description, a payment problem, suspected fraud, an address or shipping restriction, excessive quantity, or violation of these Terms. If we cancel an order after payment, we will refund the amount charged for the canceled item and associated charges.
Purchases are for personal use unless we agree otherwise in writing. We may limit quantities or refuse orders that appear intended for unauthorized resale.
4. Prices, taxes, and payment
Prices are shown in U.S. dollars. Shipping charges, taxes, and other applicable charges are displayed before the order is submitted. Prices and promotions may change before an order is accepted.
If a product is listed at an obviously incorrect price, we may contact you for approval at the correct price or cancel and refund the order. We will not charge an increased price without your agreement.
Payment is processed through the payment method and provider shown at checkout. By submitting payment information, you represent that you are authorized to use that method and authorize the applicable charges. We may use fraud-prevention measures and may request additional verification before accepting an order.
5. Promotions and gift cards
Promotions, discount codes, and free-shipping offers are subject to the terms displayed with the offer. Unless stated otherwise, offers cannot be combined, applied retroactively, exchanged for cash, or used after expiration. We may correct or cancel a promotion affected by error or abuse, subject to applicable law.
Gift cards may be used only for eligible purchases through our store. They are not redeemable for cash except where required by law. Lost or stolen gift cards may not be replaceable unless we can verify the purchase and remaining balance.
6. Shipping, delivery, returns, and refunds
Our Shipping Policy explains processing, delivery estimates, tracking, address problems, and delayed orders. Our Refund Policy explains cancellations, returns, exchanges, non-returnable items, and refunds. Those policies are incorporated into these Terms.
Delivery dates are estimates unless expressly stated as guaranteed. Risk of loss for a physical product passes to you when the product is delivered to the shipping address you provided, except where applicable law requires otherwise.
7. Permitted use of the Services
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, lawful, non-commercial purposes.
You may not:

introduce malware or harmful code;

access another person's account without permission;

scrape, crawl, copy, or harvest content or data through automated means without our written permission;

reproduce, sell, license, or commercially exploit any material from the Services without permission.
We may restrict access to protect the Services, our customers, or our rights.
8. Intellectual property
The Services and their content—including the Pasture Pool name and logos, product designs, artwork, text, photographs, graphics, and site layout—are owned by Pasture Pool or used with permission and are protected by intellectual-property laws. No rights are granted except the limited permission in these Terms.
If you believe material on the Services infringes your copyright or other intellectual-property rights, email contact.pasturepool@gmail.com with enough information for us to identify and evaluate the claim.
9. Reviews and other submissions
If you submit a review, photograph, comment, suggestion, or other content ("User Content"), you represent that you have the right to submit it and that it is accurate, lawful, and does not violate another person's rights.
You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt for formatting, and use the User Content to operate, improve, and promote Pasture Pool and the Services. This license lasts for as long as the User Content is used for those purposes; however, removing content will not require us to recall materials already produced or distributed. We may decline, remove, or moderate User Content that violates these Terms.
10. Third-party services and links
The Services depend on or may link to third-party services, including Wix, payment providers, social networks, fulfillment providers, and carriers. Third-party services are governed by their own terms and policies. We are not responsible for a third-party site or service that we do not control, but this provision does not limit our responsibility for our own obligations to you.
11. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE.
PRODUCT WARRANTIES, IF ANY, ARE THOSE EXPRESSLY PROVIDED ON THE PRODUCT PAGE OR BY THE MANUFACTURER. WE DISCLAIM IMPLIED WARRANTIES ONLY TO THE EXTENT THE LAW ALLOWS. SOME STATES DO NOT ALLOW LIMITATIONS OF IMPLIED WARRANTIES, SO A LIMITATION MAY NOT APPLY TO YOU.
Nothing in these Terms excludes a warranty, remedy, or consumer right that cannot lawfully be excluded.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PASTURE POOL AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM THE SERVICES OR A PRODUCT.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM RELATING TO A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
These limitations do not apply to liability that cannot be limited by law, including liability for fraud, willful misconduct, gross negligence, or personal injury caused by conduct for which liability cannot be excluded. Your state may provide additional rights.
13. Indemnification
To the extent permitted by law, you agree to reimburse Pasture Pool for reasonable losses, liabilities, and expenses caused by your unlawful misuse of the Services, your material violation of these Terms, or User Content that infringes another person's rights. This section does not require you to reimburse us for our own wrongful conduct.
14. Governing law and disputes
Before filing a legal claim, please contact contact.pasturepool@gmail.com so we can try to resolve the issue informally.
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules. Any court proceeding must be brought in a state or federal court in Indiana that has jurisdiction over the dispute and the parties. If the law where you live gives you a non-waivable right to bring a claim elsewhere or under another law, that right controls.
These Terms do not require arbitration and do not waive any right to a jury trial or participation in a class action that you otherwise have.
15. Changes to the Services or these Terms
We may change the Services and update these Terms from time to time. Updated Terms become effective when posted, unless a later date is stated. Changes apply prospectively and do not change the terms governing an order already accepted unless required by law or agreed with you. If a change is material, we will provide any additional notice required by law.
16. General terms
If a provision of these Terms is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, reorganization, or sale of the business, subject to applicable law.
These Terms and the policies they incorporate are the entire agreement between you and Pasture Pool concerning the Services and online purchases, except for any additional terms displayed for a specific product or promotion.
